Acceptance of terms

These terms and conditions govern all supply of goods and services ("products") by Purely Vinyl NZ, ("we, "us") to you, the purchaser of goods and services from us, including your use of the website at www.purelyvinylnz.co.nz ("the website"). They are effective from 1 September 2026 and will replace all earlier Purely Vinyl NZ terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.

To make a purchase from our online shop you must be 18 years of age or over.

Purchases from our online shop may only be made by persons who are acquiring goods or services for their own use or consumption, and you must not acquire goods from us via the website for resupply (whether in trade or otherwise).

If you are purchasing on behalf of another entity such as a company you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.

Availability and supply

All orders are subject to the availability of those products or services. If for any reason a Product is not available, we will endeavour to notify the non-availability on our online shop.

Delivery and delivery charges

Prices for goods and services stated on our website are exclusive of any applicable delivery charges.

We only deliver to New Zealand street addresses. The cost of delivery is as stated on our website and a total delivery cost will be provided in the order summary in your online shopping basket.

We will use all reasonable endeavours to ensure that orders for tangible goods will be dispatched promptly after an order has been placed.

Pricing

All prices are in New Zealand Dollars (NZD). Purely Vinyl NZ is not currently registered for Goods and Services Tax (GST), therefore GST is not charged on our products or services. All prices are correct when published. We reserve the right to alter prices at any time.

An invoice will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details are correct.

Payment options. Payment must be made in full at the time of placing your order, The payment options available to you will be displayed during the checkout process, we reserve the right to update the payment methods available on our website from time to time.

Credit Card Security. Payment transactions made through our website will be processed securely by our chosen payment provider. We do not store or have access to your full credit or debit card details. The payment options available will be displayed during the checkout process.

Shipping and delivery

We currently deliver to New Zealand addresses only. Delivery charges will be calculated and displayed during the checkout process before you complete your purchase.

As many of our products are custom-made and personalised, processing times may vary depending on the product and order requirements. We will make every reasonable effort to dispatch orders as soon as possible once they have been completed.

Delivery timeframes may vary depending on the delivery location and the courier service. Once an order has been dispatched, we are not responsible for delays caused by the courier or circumstances outside our control.

Please ensure that the delivery address provided when placing your order is correct. Purely Vinyl NZ cannot be held responsible for delays or additional costs resulting from an incorrect or incomplete delivery address.

Liability/Limitation

We take reasonable care to ensure that our products are accurately described and made to a high standard.

To the extent permitted by New Zealand law, Purely Vinyl NZ will not be liable for indirect or consequential loss arising from the use of our products or services.

Nothing in these Terms and Conditions is intended to exclude or limit any rights you may have under the Consumer Guarantees Act 1993, the Fair-Trading Act 1986, or any other applicable New Zealand law.

We make reasonable efforts to ensure that the information provided on our website is accurate and up to date.
However, information may occasionally contain errors or omissions. We reserve the right to correct any errors or update information where necessary, subject to your rights under applicable New Zealand law.

Returns

Because many of our products are personalised or custom-made specifically for you, we are unable to accept returns or offer refunds for a change of mind, incorrect choices made when ordering, or where incorrect information or images have been supplied by the customer.

Please check all spelling, names, dates, photos and other personalisation details carefully before placing your order.

If your order arrives damaged, faulty, or is not as described, please contact us as soon as possible so we can work with you to resolve the issue. Please include photographs of the product and packaging where applicable.

Nothing in these terms is intended to limit your rights under the Consumer Guarantees Act 1993 or any other applicable New Zealand consumer law. Applicable law and jurisdiction

These Terms and Conditions are governed by the laws of New Zealand. Any disputes relating to these Terms and Conditions, our website, or products purchased from Purely Vinyl NZ will be subject to the applicable laws and courts of New Zealand.

Nothing in these Terms and Conditions is intended to limit or exclude any rights you may have under applicable New Zealand consumer law.

Privacy policy and Confidentiality

Purely Vinyl NZ respects your privacy and is committed to protecting your personal information.

When you place an order or contact us, we may collect information such as your name, email address, phone number, delivery address and any information or images you provide for the purpose of creating your custom order.

Your personal information will only be used to process and fulfil your order, arrange delivery, and provide customer support.

Any photographs or personal images supplied for custom products will only be used for the purpose of creating your order unless you have given permission to use them for promotional purposes.

We will not sell or share your personal information with third parties except where necessary to process payments, deliver your order, or where required by law.

We take reasonable steps to keep your personal information secure.

If you contact us with your questions about your personal information or would like to request access to or correction of your information, please contact us through the contact details provided on our website.

Opting out of receiving the above-mentioned messages will not prevent the sending of messages that specifically relate to your order(s).

If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.

Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.
